1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Jobx platform, operated at jobx.me by Jobx ("Jobx", "we", "us", or "our"). By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use Jobx.

2. Description of Service

Jobx is an AI-powered support agent platform that allows businesses to build, train, and deploy AI agents for customer interactions. Features include knowledge base management, conversation handling, multi-channel integrations, and agent customization.

3. Eligibility

You must be at least 16 years old and capable of entering into a binding agreement to use Jobx. By using our services, you represent and warrant that you meet these requirements. If you are using Jobx on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at support@jobx.me if you suspect unauthorized access.
• You may not share your account with others or create accounts by automated means.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to use Jobx to:

• Violate any applicable laws or regulations.
• Infringe the intellectual property rights of any third party.
• Distribute spam, malware, or harmful content through your AI agents.
• Collect or harvest personal data from users of your agents without their consent.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Reverse engineer, decompile, or disassemble any part of the platform.
• Use the platform in any way that could damage, disable, or impair our services.
• Resell or sublicense access to the platform without our written permission.

6. Plans, Payments & Billing

• Jobx offers free and paid subscription plans. Plan details and pricing are listed on our website.
• Paid plans are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by law or as explicitly stated in our refund policy.
• We reserve the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
• If payment fails, we may suspend your account until the outstanding balance is settled.

7. Your Content

You retain ownership of all content you upload to Jobx (documents, knowledge base data, conversation logs). By uploading content, you grant Jobx a limited, non-exclusive license to process and store that content solely to provide the service to you.

You are solely responsible for the content your agents deliver to end users. You must ensure your agents comply with all applicable laws, including consumer protection and data privacy regulations.

8. AI-Generated Content

Jobx uses third-party AI models to generate agent responses. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. You acknowledge that:

• AI responses may occasionally be incorrect or misleading.
• You are responsible for reviewing and monitoring agent outputs.
• Jobx is not liable for any decisions made based on AI-generated content.

9. Intellectual Property

The Jobx platform, including its design, code, logos, and branding, is owned by Jobx and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary content without our prior written consent.

10. Third-Party Integrations

Jobx may integrate with third-party services (e.g. Gmail, Slack, payment processors). Your use of such integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

11. Disclaimers

THE JOBX PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOBX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF JOBX SHALL NOT EXCEED THE AMOUNT YOU PAID TO JOBX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Jobx and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the platform, your content, or your violation of these Terms.

14. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your access at any time for violation of these Terms, non-payment, or any other reason at our discretion, with or without notice. Upon termination, your right to use Jobx ceases immediately. We may retain certain data as required by law.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before they take effect. Continued use of Jobx after the effective date constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If that fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
